Rights of the Person Served

Policy:

Services will be delivered in a manner which respects the right of person’s served person served is protected from physical, sexual, psychological and fiduciary abuse; harassment and physical punishment; humiliating and threatening or exploiting actions; provision of a discussion regarding informed refusal NYRC employees are responsible to ensure the protection of those rights. Complaints, concerns, or grievances will be dealt with in an open, efficient manner.

Staff will be provided with orientation to the client rights during their probationary employment perio required to become familiar with NYRC’s policies and procedures through ethical and professional conduct, that client rights are respected, and that the necessary steps are taken to protect the confidentiality of client files and other client specific information.

Purpose:

To ensure that all persons served have a clear understanding of their rights, in a visible location in the waiting area of NYRC.

  • Adherence to applicable legislation such as the Health Care Consent Act, PIPEDA, PHIPA, etc.
  • Adherence to the Cultural Competency and Diversity Policy (NYRC)

Procedures:

All Persons served have the right to:

  1. be accommodated fairly and respectfully;
  2. privacy and confidentiality of information;
  3. freedom from abuse, financial or other exploitation, retaliation, humiliation and neglect;
  4. a clear and supported complaint process
  5. refuse services from NYRC with the provision of consequences, i.e. informed refusal
  6. receive services in a manner that is non-coercive
  7. receive services in a manner that allows for self-determination
  8. have legal guardians (substitute decision makers) participate in decision making

North York Rehabilitation Centre Corp. is committed to the goal of affecting individual change amongst our served, recognizing the unique capacities and strengths o individual diversity such as (but not limited to):

  • culture
  • gender
  • sexual orientation
  • spiritual beliefs
  • socioeconomic status
  • language

Language Barriers:

Third party translators are available including for persons that are vision or hearing impaired.

Persons with Special Needs:

For persons served with special needs, accommodations are made as needed such as access to an elevator, handicap access rooms, quiet rooms, accessible restrooms, etc.

Confidentiality of Information

NYRC will adhere by our Privacy Policy (Confidentiality) under the section “Safeguards” which states "North York Rehabilitation Centre will safeguard all personal information under our control in a manner that is appropriate to the sensitivity to the information.”

Complaints / Allegations

NYRC will adhere by our Complaint Process and Quality Improvement Tracking Policy, which states North York will identify key issues related to satisfaction surveys with NYRC service and will implement to improve or correct identified deficiencies so as to ensure issues are addressed in a timely manner.
